Dear Vinny,
My property is under contract and scheduled to close in 120 days. The buyers will be moving onto the property themselves. I know that I have a lot of things to move before closing. I want to leave some equipment and household items that were not included in the sale and/or offer to the buyers at a discounted price. What is the best way to do this? Is personal property a time-sensitive item in a real estate transaction? Will I pay my real estate agent a commission on the equipment if the sales are made outside the real estate transaction?
Dear Under Contract,
To start with, I would only pay your broker a commission on the sale of personal property if specified in your listing agreement. Your broker is hired to sell your ranch. What gets sold outside the actual real estate transaction should be between you and the buyer. I have seen several deals get compromised over personal property. Don’t get hung up on the little things. The goal is to sell the ranch, and if the buyers don’t want any personal property or you can’t come to terms on a price, sell it elsewhere or haul it to the salvage yard. Your broker should discuss this with the buyer’s broker sooner than later. Leaving things behind that were not previously agreed upon can also cause hard feelings between you and the buyer. Open communication that happens before the 12th hour of a deal can ensure a smooth transaction. Good luck with the sale.
